1. Introduction

“BRANCH INTERNATIONAL FINANCIAL SERVICES PRIVATE LIMITED” (“Branch” “Company” “we”, “our”, “us”) is a company incorporated under the Companies Act, 2013 bearing CIN No. U65929MH2017FTC296528, having its registered office at 01, AWFIS, Space Solutions, 4th Floor, VIOS Towers, Off Eastern Express Highway, Sewri-Chembur Road, Mumbai 400037. Branch is a registered non-banking financial company having a certificate of registration issued by the Reserve Bank of India ("RBI") and is engaged in the business of providing unsecured loans and such services through technology platforms such as Mobile/ Smartphone Applications.

Any access of Branch’s Services (defined below) through the Website or through the App or on any other Website of Branch or other third-party sites (“Service Sites”) will be governed by this policy which sets out the basis on which any personal data is collected from any person that visits the Website or the App or avails Branch's services (hereinafter referred to as “you”, “your”) or the data that you provide to Branch and is processed by Branch. You hereby acknowledge having read and accepted the same by use or access of the App or the Website.

This Policy has been prepared based on the legal requirements provided in The Information Technology Act, 2000, Reserve Bank of India (Non-Banking Financial Companies – Credit Facilities) Directions, 2025 and other relevant Master Directions issued by the Reserve Bank of India, The Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011; The Digital Personal Data Protection Act, 2023 (once effective); and other applicable laws, rules, and regulations governing the Company’s operations.

This Privacy Policy states the following:

  1. The type of information collected from you, including personal information relating to an individual;
  2. The purpose, means and modes of collection, usage, processing, retention and destruction of such information; and
  3. How and to whom Branch will disclose such information.

Branch respects your privacy and recognizes the need to protect the personal data or information which you share with Branch. Branch assures to follow appropriate and necessary standards when it comes to protecting your privacy on the App and/ or Website.


2. Confidentiality of Credit Information

The Company, in adherence to CICRA laws (collectively Credit Information Companies (Regulation) Act, 2005, Credit Information Companies Regulations, 2006, Credit Information Companies Rules, 2006) and Reserve Bank of India (Non-Banking Financial Companies – Credit Information Reporting) Directions, 2025, has taken necessary steps to securely handle and safeguard borrower’s credit information and personal information ensuring the protection of customer privacy. Further, privacy principles have been adopted that govern data collection, processing, and retention for all forms of credit information, whether obtained directly from customers or through credit reports. In accordance with the regulatory requirements, the Company collects, processes, and reports credit information, including historical data, as per the specified format. Data collection is done with the borrower's consent and may involve obtaining credit reports from any one or more Credit Information Companies (CICs). This information is utilized for various lawful purposes such as verifying borrower's identity, assessing creditworthiness, providing suitable products (including suitable third party products) and maintaining accurate records. To ensure the security of the information, necessary technical, operational, and procedural safeguards and protocols have been put in place, as per the Information Security Policy and KYC Policy. Security measures include:

  1. storing data on secured servers;
  2. employing encryption norms;
  3. restricting access to unauthorized personnel, thereby preventing unauthorized access, misuse, or disclosure of personal information;
  4. maintenance of logs that provide information regarding identity of all such persons who had accessed or attempted to access the credit information, the date and time of such access, and the identity of the borrower whose credit information was accessed;
  5. review of log records, at such intervals as specified in the Company's Information Security Policy to detect and investigate any unusual or irregular patterns of use of or access to data including creation of the audit trails and verification thereof; and
  6. preservation of such logs for such a period as specified in the Company's Information Security Policy (which shall not be less than two years) and making such logs available for examination to auditors, and/or the RBI.

The Company maintains the accuracy and completeness of records and reports the data as per the frequency defined under the extant regulations, to the CIC. The Company further ensures timely response to borrower requests for modifications and aligns its practices with applicable RBI regulations for compensating customers for delayed updation or rectification of credit information. The grievance redressal mechanism of the Company for the purpose also includes recourse through the RBI Ombudsman for wrongful denial of compensation.


3. Consent

By affirming your assent to this Privacy Policy, you provide your explicit consent to such collection, use, storage, processing and disclosure as set out in this Privacy Policy and the Terms and Conditions.

Further,

  1. You also understand that any or all the Information may qualify as “sensitive personal data” under the Information Technology Act, 2000. Applicable Laws necessitate Your prior explicit consent in order for “sensitive personal data” to be collected, stored and processed by Us for the purposes of offering Services through the Application and You provide such consent.
  2. You confirm that the email ID and mobile number registered by you using the App is under your control and exclusive use and you take all possible measures to ensure secure access to such resources.
  3. You shall be responsible for ensuring the Company has been and continues to be provided with an up-to-date, active and deliverable email address and mobile number to receive necessary communications.
  4. Communications sent to the e-mail address or mobile number registered with Application will be deemed to be validly served to you.
  5. You agree to, periodically and based on communication received, visit our Website and this Privacy Policy to check for any changes.
  6. You covenant that you shall not attempt to circumvent any of the privacy settings or security measures contained on the Website and any damage to you arising because of or incidental to such attempt shall not lead to any liability on the part of the Company.

4. What Information We Collect

Branch will track the internet protocol address from which you access the App and analyse this data for trends and statistics. Along with receiving information from third parties about you, Branch may also collect your information in the App by information filled in forms or by your correspondences with Branch, by way of e-mail or chat, registering to use the App, downloading or registering the App, subscribing to any of Branch’s financial services or products (“Services”), searching for an App, sharing data via the App’s social media functions, entering a competition, promotion or survey and reporting a problem with the App or a Service Site through your computer, mobile phone or any other device which may include, but is not limited to, your internet protocol address, device information including but not limited to identifier, name and type, operating system, approximate location, mobile network information, device phone number, SIM card details, age, financial and credit information including your mobile handset details, bank account details, , personal description (such as your name, age, date of birth, gender, address, email ID, mobile number, employment status, educational qualification, purpose of availing Services, citizenship, government ID proofs, photograph), time zone setting, information stored on your device including Commercial SMS logs, Calendar data, presence of fixed number of apps installed and standard web log information including but not limited to your browser type, traffic to and from Branch’s App, the pages you accessed on Branch’s App, location data, weblogs. We do not collect any biometric data unless allowed under extant statutory guidelines. When you use the Services, Branch may also store information based on your App usage history, this includes, but is not limited to, details of your subscription, content you viewed, event information, clickstream information, and cookies that may uniquely identify your browser or your account. Branch may also store the unique application number provided to you while you install or uninstall a service or when a service searches for automatic updates. Branch may also collect information about you from any contact you have with any of Branch’s Services or employees, such as, with Branch’s customer support team, in surveys, or through interactions with Branch’s affiliates.


5. Why We Collect Information

The Information we collect from you or from Third Party Partners are used and processed for (1) Contractual Purposes (2) Legal Obligations (3) Legitimate Interests.

  1. Contractual Purposes
    1. providing any of the Services to you including and not limited to determining whether or not to provide a service to you, the applicable terms of such service and the terms and conditions applicable to such service. We are unable to make this determination unless we collect and process data in accordance with our terms and conditions; or
    2. communicating with you regarding requests about our Services or Services provided to you.
  2. Legal Obligations
    1. identification, validation, and verification of your identity;
    2. processing of payment and settlement instructions;
    3. collection of loans and any amount outstanding from you;
    4. compliance with any risk, regulatory duty or lawful obligation including responding to regulators or supervisors, carrying out anti money laundering investigations, record keeping obligations, etc;
    5. carrying out risk analysis and assessments of our Services, Service Sites, and market;
    6. compliance with codes of conduct or best practices; or
    7. troubleshooting issues with our Services and Service Sites;
  3. Legitimate Interest
    1. fraud detection and prevention of other illegal use of our Services and Service Sites;
    2. improving our Services to you and your experience with us;
    3. offering rewards and other incentives to you;
    4. collaborating with Third Parties to provide a Service or to improve our services to you;
    5. educate you about Services or any other information that might be useful to you as our customer;
    6. improving our business, processes, policies, etc;
    7. improve our data quality;
    8. carry out research, experiments, and tests; or
    9. marketing, advertising, and sensitization of our Services;

When you use our services on the mobile App, we also collect the following information from your smartphone;

  1. Location: An approximate location is used to check your serviceability and to prevent fraud.
  2. SMS: Our system reviews your financial SMS to understand your financial history and personalise your loan offers.
  3. Installed apps: Our system checks for the presence of a fixed number of apps installed on your device for fraud detection and to personalise your loan offers.
  4. Calendar: Our system accesses your calendar to remind you of loan repayment dates.

You hereby provide your explicit consent for Branch to access your mobile phone/ device for a ‘one time’ access of camera, microphone, location or any other facility necessary for the purpose of on- boarding/ KYC and such other requirements.

We access this information through your mobile device operating system when you give explicit consent to your device’s permissions on our App.

Branch develops statistics that are helpful to understand how Branch’s Visitors can use the App. Branch uses this information in the aggregate to measure the use of the App and to administer and improve the same. This statistical data is interpreted by Branch in its continuing effort to present in the App, content that Visitors are seeking in a format they find most helpful.

You agree that Branch or Branch’s third-party service providers can collect your IP address or other unique identifier. At times, Branch also uses these identifiers to collect information regarding the frequency with which the Visitors visit various parts of the App. Branch, either itself or through affiliates or group companies may combine your internet protocol address with other personal information for Branch’s own marketing and for market research purposes, including internal demographic studies, to optimize Branch’s products and Services and customize the App for you.

Branch may combine your visitor session information or other information collected through cookies, web beacons and other technical methods with any personal information to understand and improve your App experience and to determine what products, promotions and Services you prefer or are likely to be of interest to you.

Cookies, web beacons and other technical methods may involve the transmission of information either directly to Branch or to another party authorised by Branch to collect information on Branch’s behalf. The information from use of these technical methods may be collected in a form that identifies you personally. Details of third parties allowed to collect personal information through the App or with whom Branch shares your personal information is listed under https://branchapp.in/policies.

There are times when Branch may collect personal information from you as listed under Para 4 of this Policy. If you choose not to provide the information we request, you can still visit the App, but you may be unable to access certain options, offers and Services.

In case you wish to prevent any such usage by Branch, you are required to inform Branch that you want to restrict certain usage of such information. You can exercise this right at any time by contacting Branch at [email protected].


6. Where We Store Your Personal Data

Wherever Branch has provided or you have chosen a PIN to access any part of the App or Service Sites, you shall be responsible for keeping the PIN confidential. Branch maintains, stores and processes your data in India, as reasonably necessary for the proper performance and delivery of the service, or as may be required by law. We shall endeavour to ensure the same for our authorised Third-Party Service Providers as well.

In case the data is processed outside India, the same shall be deleted from servers outside India and brought back to India within 24 hours of processing.


7. Data Retention and Deletion

Branch will retain your information for such period as necessary to provide you Services as permitted under applicable laws, or for audit purposes, or if we deem it necessary for detection or prevention of fraud, or if required by law, or in case we receive a statutory and/or regulatory order to retain the data. Neither your repayment of any loan availed through the App, nor the deletion of your account with the App, automatically revokes your consents provided to Branch under this Privacy Policy.

Upon completion of the retention period, Branch shall destroy/delete your personal information in its possession in such manner as permissible under applicable laws.


8. Legal Rights

  1. Deletion of your information: We will comply with any request received from you for deletion of your personal information shared with Us, subject to applicable laws, our statutory obligations, and the terms of the Services availed by you.
  2. Right to deny consent: You may deny Branch the consent required to process your personal information or disclose it to third parties. You agree and understand that certain information may be required to provide Services and if you decide to deny consent, it may restrict our ability to provide you Services.
  3. Right to revoke consent: You may withdraw your consent provided previously to Branch for use and/or retention of information, and/or sharing of information with third parties. You understand that if you have availed a loan through the App which is not closed at the time of your revocation request, we will continue to process your information to facilitate the Services to you till the loan is closed and till we require the information to fulfil our statutory obligations.
  4. Right to rectify: You understand that you will be responsible for the authenticity of the information provided by you to Branch. You may request updation and/or correction of your information previously provided to Branch.

9. Google API Disclosure

Branch's use of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.


10. Sharing of Information

Branch may use the personal information that you have shared during the process of registration or otherwise for verification purposes, including your KYC data/documents. You agree and allow Branch to share such information with our partner lenders for credit underwriting, KYC verification, and offering you Services, third parties for verification purposes, credit information companies for reporting and with government agencies, including but not limited to the Reserve Bank of India (“RBI”) for the cause of an inspection or any other legal diligences which may be conducted by it. Branch may also use the information you provide to update Branch's consumer credit database.

When you visit the App, you agree that Branch or any of Branch’s partners/affiliates/group companies/subsidiaries/holding company/collection agents may contact you from time to time to provide the offers/information of such products/Services that Branch believes may benefit you or to get information about any repayments due or any other promotional or transactional information Branch wishes to receive from you. Details of third parties allowed to collect personal information through the App or with whom Branch shares your personal information is listed under https://branchapp.in/policies. You agree that Branch may provide information collected from you to government authorities or credit bureaus as per the rules laid down by RBI or any court of law as per the applicable laws of India.

Branch or any of Branch’s partners/affiliate/group companies/collection agents may contact you for any promotional, transactional or any other purpose by way of phone, SMS, email, push notification, Calendar notification, etc.

It is possible that Branch may need to disclose personal information when required by law, such as responses to civil or criminal subpoenas, or other requests by law enforcement personnel. Branch will disclose such information wherein Branch has a good faith/ belief that it is necessary to comply with a court order, ongoing judicial proceeding, subpoena, or other legal process, or to exercise Branch’s legal rights or defend against legal claims.


11. Disclosure to Third Parties

Branch may disclose your personal information to third parties in the following events:

  1. If Branch sells or buys any business or assets, in which case Branch may disclose your personal data to the prospective seller or buyer of such business or assets;
  2. If Branch or substantially all of Branch’s assets are acquired by a third party, in which case personal data held by it about you will be one of the transferred assets;
  3. If Branch is under a duty to disclose or share your personal data in order to comply with any legal or regulatory obligation or request; and/or
  4. In order to report loan activity to any credit bureau; or for the purpose of publishing statistics relating to the use of the App, in which case all information will be aggregated and made anonymous.

12. Link to Third Party Websites

Branch may link to third-party websites which may be Branch’s integration partners. These third-party websites may collect information about you on those websites, and Branch‘s Privacy Policy does not extend to such third-party websites. Please refer directly to the websites of such third parties and their privacy policies.


13. Security Measures and Procedures

Branch will not sell, trade or disclose to third parties any information derived from the registration for, or use of, any online Service (including names and addresses) without your consent save and except to any of Branch’s affiliates or group companies for helping you in receiving loans or other Services in relation to the businesses of Branch’s affiliates or group companies and as may be required by legal process or in the case of imminent physical harm to any persons. Branch will not sell, trade or disclose to third parties any information derived from the registration for, or use of, any online Service (including names and addresses) without the consent of the user or customer save and except to any of Branch’s affiliates or group companies for helping you in receiving loans or other Services in relation to the businesses of Branch’s affiliates or group companies and as may be required by legal process or in the case of imminent physical harm to any persons. Further, Branch will allow its affiliates to access the information for purposes of confirming your registration and providing you with benefits you are entitled to.

Branch will take appropriate steps to protect the information you share with Branch. Branch has implemented technology and security features and strict policy guidelines to safeguard the privacy of your personal information from unauthorized access and improper use or disclosure. Branch will continue to enhance Branch’s security procedures as new technology becomes available.

Branch may transmit the information collected from you through the internet to another country, among Branch’s affiliates and group companies, for purposes such as for storage, or for carrying out the processing detailed above, or because of where Branch’s servers are located.


14. Changes to Privacy Policy

Branch may change this Privacy Policy from time to time without requiring any consent from anyone, subject to approval by the Branch’s Board of Directors. If Branch’s Privacy Policy changes in the future, it will be posted here and a new effective date will be shown. You should access Branch’s Privacy Policy regularly to ensure you understand Branch’s current policies. Branch will attempt to respond to all reasonable concerns or inquiries on a best-efforts basis within a reasonable period of time.


15. Governing Law and Dispute Resolution

This Privacy Policy shall be governed in accordance with the laws of India and any disputes arising out of or in connection with this Privacy Policy shall be subject to exclusive jurisdiction of the courts in Mumbai.
